This data Privacy Notice serves as a demonstration of our commitment to handling personal data with confidentiality and respect. Your privacy is our top priority, and we acknowledge the importance of transparency in the processing of personal data by us.<\/p><p><strong>NB: <\/strong>Personal data is information that directly or indirectly identifies an individual who is referred to as the data subject, and, in the course of our engagement with customers, personal data will be collected. The data is collected through the Know you Customer (\u201c<strong>KYC<\/strong>\u201d) and Lease Agreement Requirements forms which must be populated by the data subject and submitted to us with the supporting documentation attached to the form. The lawful grounds on which we collect this personal data are:<\/p><ul><li>For compliance with the legal obligations, in particular the requirement to conduct customer due diligence; and<\/li><li>For transaction monitoring for the duration of the lease agreements.<\/li><\/ul><p>Some of the personal data, e.g., such as personal data of directors and\/or shareholders will not be collected directly from the data subjects, it may be given by another data subject being fully authorized to do so, it may be sourced from publicly available sources and from third parties such as anti-money laundering and\/or counter terrorism platforms for due diligence.<\/p><p><strong>RETENTION PERIOD<\/strong><\/p><p>We retain the personal data we have collected for a period that is specified by law, such as 20 years for personal data collected for customer due diligence in terms of the Financial Intelligence Act or for a period within which such data is crucial for the achievement for the maintenance of our business relationship.<\/p><p><strong>RECIPIENTS<\/strong><\/p><p>We share personal data with external parties as and when the need arises. These external parties include:<\/p><ul><li>The Non-Banking Financial Institutions Regulatory Authority (\u201c<strong>NBFIRA<\/strong>\u201d) for regulatory purposes;<\/li><li>Financial Intelligence Agency (\u201c<strong>FIA<\/strong>\u201d) and\/or any regulatory authority that requests the information pursuant to the performance of their mandate; and<\/li><li>Service providers, referred to as Data Processors, including but not limited to External and Internal Auditors, Information Technology service providers and AML\/CFT service providers among others.<\/li><\/ul><p>When we share personal data, we put at the forefront the principle of data minimisation to ensure that we only share personal data which is strictly necessary for the purpose to be achieved by the disclosure. The personal data is shared with safety and security measures implemented through the Data Sharing Agreements with our Data Processors to ensure that they warrant and guarantee their adherence to data protection laws.<\/p><p><strong>DATA SUBJECTS RIGHTS<\/strong><\/p><p>Data Subjects may exercise the following rights in relation to their personal data:<\/p><ul><li>The right to access personal data on request<\/li><li>The right to correct or complete personal data<\/li><li>The right to erase personal data (subject to exceptions, for more details please contact our DPO mentioned in our Notice)<\/li><li>The right to restrict the processing of personal data<\/li><li>The right to object to the processing of personal data (subject to exceptions, for more details please contact our DPO mentioned in our Notice)<\/li><li>The right to data portability<\/li><li>The right to not be subject to decisions solely based on automated decision making<\/li><\/ul><p>The extent to which the above specified rights may be exercised depends on the purpose of processing, the legal basis of processing and the respective retention period.<\/p><p>Feel free to engage us to exercise any of the rights and we will indicate if there are any conditions to be met in relation to the right you seek to exercise looking at the circumstances. We will further indicate if there are any exceptions to the right you seek to exercise as well as the limitations to the right\/s you wish to exercise. These exceptions and limitations will be justifiable under our data protection Policies and in adherence to the Botswana Data Protection Act.<\/p><p>The Data Subject also has a right to lodge a complaint to the Information and Data Protection Commission regarding the exercise of your rights or any contravention of the Data Protection Act.\u00a0<\/p><p><strong>CHANGES TO THIS NOTICE<\/strong><\/p><p>This Notice may change from time to time such changes being due to amendments to provisions in the Data Protection Act which may have an effect of the applicability of the Notice.
